Two things help the most: (1) earlier warnings or related notices from the board, and (2) how the notice affected you— did you miss a deadline, struggle to figure out which bylaw was cited, have trouble reaching the corporation, or feel you couldn't respond properly? The CDRT looks at both substantial compliance and whether the owner was prejudiced, so anything that speaks to those two questions sharpens the assessment.
